The legal services provided in the purchase and sale of real property vary greatly depending on whether we represent the purchaser or seller. Generally, our services are as follows:

Representation of Purchaser:

  • Review the Purchase/Sale Contract
  • Comply with contract dates, inspections, contingencies, terms and conditions
  • Review the proposed Deed
  • Review the Mortgage Commitment and comply with the Lender’s requirements
  • Order the Title Report, review the Title Report and comply with the title company requirements.  Order the Title Insurance
  • Prepare the Equalization and Assessment form #RP-5217
  • Prepare the Statement of Sale for closing
  • Review the Lender HUD-1 (Settlement Statement)
  • Review the documents to be signed at closing
  • Attend the closing (generally at the office of the lender’s local attorney)
  • Arrange for the title company to record the deed, mortgage and related closing documents

Representation of Seller:

  • Review the Purchase/Sale Contract
  • Comply with the contract dates, inspections, contingencies, terms and conditions
  • Prepare and deliver the proposed Deed to the Buyer’s attorney and the Lender’s attorney
  • Prepare the final Deed conveying title from seller to buyer
  • Review the Title Report and comply with the title company requirements
  • Obtain the mortgage payoff information from existing lender(s)
  • Prepare the Statement of Sale for closing
  • Prepare the Gains Tax Affidavit form #TP-584
  • Review the documents to be signed at closing
  • Attend the closing (generally at the office of the lender’s local attorney)
  • Arrange for the title company to pay off existing liens

ADDITIONAL SERVICES such as the preparation and negotiation of a Residential Purchase and Sale Agreement, Cancellation and Release of Contract, Limited Power of Attorney, Holdover or Early Occupancy Agreement, Promissory Note and/or Mortgage, are available.
