New York ∙ Rochester ∙ Divorce Lawyer ∙ Seperation Lawyer
The Hersch Gelb Law Firm has practiced in the area of matrimonial law since 1995. We have been a law guardian, mediator and matrimonial fee dispute arbitrator. We are a member of the Family Law Sections of the New York State Bar Association.
We, at the Hersch Gelb Law Firm, are aware that the issues involved in Divorce matters are sensitive and generally have numerous permutations, especially if children are involved. Matrimonial matters often are resolved by a written agreement, frequently referred to as a Separation Agreement, which is signed and acknowledged by the parties. It becomes their private contract which is usually made part of their judgment of divorce. Entering into an agreement avoids the time and expense of litigation and the related uncertainties of allowing another person (the Judge) to make binding decisions. It is our opinion that written agreements are preferable to litigation. However, there are times that the resolution of a matter cannot be reached by agreement, and litigation is required. If litigation is required, we at the Hersch Gelb Law Firm are prepared to vigorously advocate your position.

In the context of divorce proceedings, the parties’ marital property is equitably distributed. Case Law and Statutory Law define what constitutes marital property and how to value it. As a general rule, property acquired during the marriage is considered marital property, subject to distribution. This includes pensions, deferred income and IRAs, business interests and advanced educational degrees. Only Supreme Court, not Family Court, can order the distribution of marital property.
We at The Hersch Gelb Law Firm welcome the opportunity to help you resolve your marital difficulties in a manner that is most beneficial to you and your family.
